Limitation of Liability

By agreeing to this document, I hereby acknowledge that I have voluntarily chosen to participate in a program of intense physical exercise. I further acknowledge that Elevate Spin highly encourages that I consult with my physician prior to taking my first class. I acknowledge that I am fully informed of the strenuous nature of this exercise program and the possibility of adverse physiological occurrences including, but not limited to, abnormal blood pressure, fainting, heart attack or death. By signing this document, I assume all risk for my health and well-being, and fully release and hold harmless for any responsibility, cost including attorney’s fees or damages Elevate Spin Inc. and any and all of its subsidiaries doing business as Elevate Spin, and the instructors, members, and employees of these entities. 

I acknowledge that my agreement to this release applies to today and each time I visit Elevate Spin hereafter. I hereby acknowledge that I, and any minor under my care, have voluntarily chosen to participate. I acknowledge that those under 16 are not eligible to participate in Elevate Spin activities unless accompanied by a parent or guardian. I assume all risk for my health and well-being, and that of any minor under my care, and fully release Elevate Spin Inc. and any and all of its subsidiaries doing business as Elevate Spin from all liability. 

Permissions

I hereby grant permission to Elevate Spin, and its employees, agents, and representatives to photograph and record my image, likeness, or depiction. I hereby consent to and permit Elevate Spin to edit, crop, or retouch such images, and waive any right to inspect the final images. I hereby consent to and permit images of me to be used by Elevate Spin for advertising and promotional purposes in any medium, including print and electronic. I understand that Elevate Spin may use such photographs with or without associating names thereto. I further waive any claim for compensation of any kind as a result of Elevate Spin’s use or publication of photographs of me. I hereby fully and forever discharge and release Elevate Spin from any claim for damages of any kind arising out of the use or publication of any such photographs.

Class Cancellation and No-Show Policies

I understand that any class for which my booking reservation has been confirmed must be cancelled at least 8 hours in advance of my scheduled booking. I understand that if I currently have an Elevate Spin unlimited monthly membership either a 1-month, 3-month, 4-month, 6-month, or year membership I will be issued a late cancellation fee of $15 per incidence within of the 8-hour window. I understand as an individual who holds an Elevate Spin unlimited membership failure to cancel or show up for the class will be issued a no-show fee of $20. I acknowledge as a Class Cardholder either 5-class, 10-class, or 20-class that I will lose my class for failure to cancel within the 8-hour window or in the event of a no show.

Contract Cancellation

I understand that the purchase of an unlimited membership requires me to fulfill the entire length of the membership of one month, three months, four months, six months, and twelve months respectively. In the event of a requirement to cancel your unlimited membership commitment, you are required to provide a doctor’s note or proof of moving. I acknowledge that I can put my membership on hold for one month to a maximum of three months and will be charged $15/month in lieu of regular membership price.

Optional Communications

I understand that by providing my email address I consent to receiving communication regarding promotions, or events from Elevate Spin Inc. I understand consent to receiving promotional emails is not a condition of signing up and that I can unsubscribe at any time.

By agreeing to the Terms and Conditions, I hereby confirm and agree that I have read and understood the above agreement and that I am the age of majority or older. I voluntarily agree on my behalf or the behalf of a minor in my care.
